Aurelia Byron — Terms & Conditions

Property: Aurelia Byron — Unit 104, 137–139 Jonson Street, Byron Bay NSW 2481

Booking Agent: Beach Houses of Byron (BHOB) – our exclusive agent for all reservations, payments and cancellations.


IMPORTANT: Payment of any pre-payment or balance constitutes acceptance of these Terms & Conditions and BHOB’s booking terms. Our property Terms apply in addition to BHOB’s and the building’s strata by-laws. If there is any inconsistency about booking, payments or cancellations, BHOB’s terms prevail. If there is any inconsistency about property use, house rules or strata compliance, these Aurelia Byron Terms prevail.


1) Booking, Rates & Payments

  • All bookings, confirmations, amendments and cancellations are handled by Beach Houses of Byron. Their booking confirmation is required for a valid reservation.
     
  • Currency: Australian Dollars (AUD). GST included where applicable.
     
  • Card surcharges, deposit schedules, balance due dates and non-payment consequences are as per BHOB’s policy.
     
  • You must check your BHOB confirmation and notify BHOB of any discrepancies within 48 hours.
     


2) Arrival & Departure

  • Check-in: from 3:00 pm (or as advised by BHOB).
     
  • Check-out: by 10:00 am. Late check-out is by prior approval only and may incur fees.
     
  • Keys/fobs must be returned to the key safe on departure. Replacement costs apply for any lost or unreturned keys/fobs.
     


3) Use of Premises & Strata By-Laws (Strict)

This residence is within a strata building. All guests must comply with the building’s by-laws and these house rules:

  • Quiet hours: 10:00 pm – 7:00 am. No amplified music, shouting or balcony noise during these times.
     
  • No parties or events. Schoolies bookings are not accepted.
     
  • No pets of any kind.
     
  • Registered guests only. No visitors beyond the occupancy declared at booking without prior written approval.
     
  • Maximum occupancy/capacity must not exceed what is stated on your BHOB confirmation and as permitted by strata/insurance.
     
  • Balconies/commons: no smoking, no throwing objects, no storage of surfboards/bikes except where designated.
     
  • Rubbish & recycling: use the bins provided; do not leave rubbish in corridors or common areas.
     
  • Parking: use only the two allocated spaces for Unit 104; do not park in other bays or common areas.
     
  • Fire & safety: do not tamper with smoke alarms or fire equipment; notify BHOB immediately of any issue.
     

Breach of the above may result in call-out fees, fines, additional cleaning/repair charges, eviction without refund, and deduction from the bond/credit card.


4) Cleaning, Care & Damage

  • The residence is professionally cleaned between stays. Standard exit expectations: wash/dishwasher-clean and put away kitchenware; BBQ cleaned if used; furniture returned to original position; remove rubbish to building bins; close and lock doors/windows.
     
  • Damage, breakage, staining, lost items or excessive cleaning will be charged at cost + admin and may be deducted from your security bond or card on file.
     
  • Towels/linen are not to be removed from the property (a beach kit is provided when available).
     
  • Please report any issues or damage to BHOB promptly so we can assist.
     


5) Noise, Security & Call-outs

  • Offensive noise or behaviour that disturbs neighbours or other residents is prohibited at all times and strictly during quiet hours.
     
  • Security or building manager call-outs arising from guest behaviour will be charged to the booking. Repeated breaches may lead to immediate eviction without refund.
     
  • The property may use privacy-respecting noise monitoring (decibel-only, no audio recording) to support by-law compliance.
     


6) Cancellations, Changes & Refunds

  • Cancellations and changes are managed by BHOB under their policy (including any COVID-19 provisions).
     
  • Where a force majeure or unplanned outage (e.g., power/Internet) occurs, we and BHOB will assist reasonably, but no liability is accepted for circumstances beyond our control.
     


7) Security Bond & Charges

  • A refundable security bond/credit pre-authorisation is required as per BHOB’s policy and timing.
     
  • We may charge the bond/card on file for: damage, missing items, excess cleaning, unauthorised occupancy, smoking evidence, security call-outs, key/fob replacement, and by-law fines.
     


8) Smoking, Vaping & Fire Risks

  • Strictly no smoking or vaping anywhere inside the residence, on balconies, or in common areas. Evidence of smoking will incur significant cleaning/deodorising charges and may lead to eviction.
     


9) Accessibility & Safety

  • Lift access from parking to the residence. Single-level interior.
     
  • Guests must supervise children on balconies and around common areas at all times.
     
  • Do not exceed the legal/posted limits for the rooftop pool or other common facilities.
     


10) No Tenancy

Your booking grants a limited licence to occupy for holiday accommodation. It is not a residential tenancy under NSW residential tenancy legislation. Failure to comply with these Terms or BHOB’s booking conditions may result in immediate termination and eviction without refund.


11) Personal Property & Liability

Guests are responsible for their personal property. Items left behind may be returned if found; postage/handling at guest cost.
To the maximum extent permitted by law, Aurelia Byron and BHOB accept no liability for loss, damage, injury, delay or expenses arising from your stay, except where caused by our negligence.


12) Insurance

We strongly recommend comprehensive travel insurance, including cover for cancellations, interruptions, and personal effects.


13) Amendments

These Terms may be updated without notice. The version posted on our website at the time of booking applies, together with BHOB’s current booking terms.
